Tennessee Attorney General Robert Cooper and Connecticut Attorney General Richard Blumental -- along with AG staffers from Connecticut, Iowa, Kansas, Louisiana, Maryland, Mississippi, Missouri, Nebraska, Ohio, Oklahoma, Rhode Island, Tennessee, Washington, and Wisconsin --met with FCC Commissioner Deborah Taylor Tate on July 1 to discuss their concerns regarding the long-pending proposed merger of XM Satellite Radio and Sirius Satellite Radio.

Unauthorized Broadcasting of Telephone Conversations

The Federal Communications Commission has expanded its penalties for the unauthorized broadcast of telephone conversations. In order to protect expectations of privacy, the FCC does not permit telephone conversations to be broadcast without the knowledge and consent of all parties. An exception is where the parties may be presumed from the circumstances to be aware (or are actually aware) that at least part of a conversation is likely to be aired (as during a call-in discussion program).

Court Tosses FCC 'Wardrobe Malfunction' Fine

A federal appeals court on Monday threw out a $550,000 indecency fine against CBS Corp. for the 2004 Super Bowl halftime show that ended with Janet Jackson's breast-baring "wardrobe malfunction."
The three-judge panel of the 3rd U.S. Circuit Court of Appeals ruled that the Federal Communications Commission "acted arbitrarily and capriciously" in issuing the fine for the fleeting image of nudity.

Upcoming Deadlines Relating to Cable and Satellite Carriage of Television Stations

July 31, 2008 is the deadline by which television stations are required to file claims for copyright royalties with the Copyright Office.  FCC rules require television stations to make signal carriage elections by October 1, 2008 for the period 2009-2012. The upcoming termination of analog broadcasts makes this year’s carriage elections especially important. In addition, television stations that will terminate analog broadcasting have a special October 1 notice obligation with respect to satellite operators.

For Television Broadcasters Electing Option 2 On Their FCC Form 388, Mandatory DTV 100-Day Countdown Announcement Must Commence On November 10, 2008.
As previously reported, on March 3, the FCC released a Report and Order outlining the requirements for the education of consumers regarding the February 17, 2009 transition to digital television service. Full-power television broadcasters were instructed to choose between one of three methods, defined as “Options 1, 2, or 3,”  for disseminating such information.
All commercial and noncommercial digital television broadcast station licensees and permittees that elected Option 2 must commence the 100-day Countdown announcements mandated in the March Report and Order  on Monday, November 10, 2008.
